Girlfriend will stay at man’s house despite having been thrown out, Turkish court rules

A family court in Ankara has ruled that a woman who moved to her boyfriend’s house two years ago and was subsequently thrown out onto the street by him should stay at the house while the man should stay away from her for six months.

Ankara 11th Family Court’s decision was rare as the couples were not married officially or through a religious ceremony.

Ş.Y., 34, applied to the Lalahan district Gendarmerie Command saying that her boyfriend, Ş.K, 36, prevented her entering the house they had been sharing for the past two years. Gendarmerie applied to the Ankara public prosecutor’s office’s violence bureau with a notice about the incident.

Judge Mehmet Adıgüzel decided that Ş.Y. should return to her boyfriend’s house while the man should stay away from the house and woman for six months.

The Judge banned Ş.K. from resorting to any kind of violence, including threatening to use violence, insulting actions or speech, against Ş.Y., and prohibited him from coming close to her place of residence, school or workplace, and from damaging her personal belongings or household goods. The communal residence is to be allocated to the person under protection and Ş.K will not be permitted to disturb the woman under protection through communication devices.

Ş.Y. said in her testimony that she was living with her family when she met with Ş.K., who allegedly persuaded her to live together and promised that they were going to get married. She said her relations with her family got worse after she moved into Ş.K’s house and that she could not return to their houses anymore. “He did not keep his marriage promise. He has beaten me when I went to the doctor without his knowledge. My one leg has a plate so that I cannot do housework properly and he is insulting me because of that. I don’t have anywhere to go. I don’t want to leave that house,” said Ş.Y. in her testimony.
