Minor stealing cigarette sentenced to seven years

A minor was sentenced to seven years and six months in prison on charges of stealing a packet of cigarettes, daily Milliyet reported Sunday.

A letter sent by the 13-year-old, identified only by his initials O.G., to a member of the Parliamentary Human Rights Inspection Commission revealed that the minor has been in a prison in the central Anatolian province of Kayseri for two years now.

Ali Rıza Ertemur, a member of the commission, said they would follow the case and that O.G.’s files have been waiting at the Supreme Court of Appeals for two years.

“O.G. is in prison for one packet of cigarettes. Those who commit murder or even terrorists are getting away with lighter punishments. I will not stop following this case,” said Ertemur.

A sub-commission of the parliamentary commission visited the Kayseri İncesu Juvenile’s Prison where O.G. asked for a card from Ertemür. Later on, O.G. wrote a letter to Ertemür saying that the local court’s decision was sent to the Supreme Court of Appeals, but it has failed to discuss his case for two years now.

“What if the Supreme Court of Appeals reverses the local court’s decision? Then, would all this wasted time not be a shame for the child?” asked Ertemür.

  Come on Turkey... this is the 21st century.. This is a good example of how important citizens are to this government. Prison is no place for a child, the streets are no place for children, schools are where they should be. Children are being abused everyday, in the world. Does anyone care? What good will it do to keep this child in prison? What do the officials think he will be like, when and if he gets out of prison?

  I submit that the members of Turkish Judiciary have never read nor is it a part of their legal training cariculum, Victor Hugo's, "Les Misarables" In the case of child O.J., now two years in Juvenile detention, which he must have entered at age of eleven. Pehaps the Turkish legal codes demans such a harsh sentence, like the eight year old girl got eight years of trowing a rock the police. The word "judGE" implies that a human,is being entrusted with the responsibility to make human and moral decision. Instead in this cases the Judges actslike the High Lord and Executioner. I wonder if hey have families of their own? They must feel very proud of themselves!

  Agree with guest Bryan, the Judges and the state prosecutor should be tried and convicted for Child Abuse. THEY SHOULD BE IN PRISON FOR 10 YEARS. Its an uncorrectable shame, the childs life is now in ruins.Appears the Judges and Prosecutor are not true beleivers or Moslums.If they could read the Quarn, they would see that they are unforgiving and do not follow the teachings of the Prophet. Shame Shame Shame on them Turkish Protestors, i see you on TV every day, protesting stupid things, like price of fish,bla bla bla, Go protest in favor of releasing this boy now, send him to school, teach him with love and care. President Gul, USE YOUR PRESIDENTAL POWER, GIVE A IMMIDATE PARDON TO THE CHILD, help him. Now I know why turkey will never be a part of the EC,with stupid horrors like this done.

  Sending a child to prison because of the theft of a packet of cigarettes contrasts sharply with what justice should be about. A child who is imprisoned for a number of years for whatever reason cries out to the world to shame the nation. If the Law Courts could not do otherwise because of exisiting legislation, the latter should be changed immediately.

  As can be seen in this case, the Turkish judiciary system DEFINITELY needs an overhaul! To incarcirate a child for stealing a packet of cigarettes, whilst allowing PKK terrorists, and pedophiles like Halis Toprak etc. to walk free, without trial, is in NO WAY JUST!

  When are Turks going to realise that the world has moved forward from archaic laws allowing such harsh penalties on offences involving minors. A 13 year old needs help and rehabilitation not his life ruined.

  This antiquated behaviour by the Turkish authorities is disgusting and repugnant. Further, it does so much harm to the image of Turkey in the most of the rest of the world. Action needs to be taken immediately by the government to ensure that situations such as this do not occur in the future. In the meantime, the CHILD needs to be released immediately and efforts made to help him in every way. This child has probably been so damaged that his total rehabilitation in not possible. This is shameful: Shame on every member of the Turkish government for allowing this situation to have occurred.

  It is very important that the judges and prosecutors involved in this case will be fired as soon as possible, and that a new institution must be created to guard for the safety of children in prisons. There should be an investigation if there are more cases like this one, and what laws must be changed accordingly. Children should not be sent to jail, at least not children under 16. Instead children should be put in small-scale rehabilitation houses or be given some other alternative punishment. Judges should be tought to think for themselves as well, not blindly follow the laws. Then there should be a board of judges to oversee that all judges stay within moral and just boundries.

  This is a crazy sentence. And the child has been in prison for 2 years now, for stelaing something worth less than 5 lire! Is not Turkey a signatory of the European Convention on Human Rights, that includes the rights of children? We have a Turkish minister complaining about a couple of kisses on a TV series while a child is locked up for a minor offence! If he is 13 now and is two years in detention that means he was 11 years old when he stole the cigarettes? Oh my, what kind of justice system do you have over there. The judge who made this decision should himself or herself be jailed for child abuse!
