The Court of Appeals 8th Criminal Chamber has suspended the trial of Trabzon Motherland Party (ANAP) Deputy Eyup Asik until his legislative immunity is lifted, since he was re-elected to Parliament in the April 18 elections, reported the Anatolia news agency.

After his telephone calls with Alaattin Cakici were revealed, a case was brought against Asik on the basis of Article 314 of the Turkish Penal Code (TCK) for "assisting a member of a criminal gang." The indictment seeks a sentence of one to five years of imprisonment.

Referring to Article 83 of the Constitution -- which says that in order to try an elected deputy who has allegedly committed a crime, whether before or after being elected, the approval of Parliament must be obtained -- the court ruled that since Asik had been re-elected to Parliament, the trial would be suspended until his legislative immunity is lifted.

On the basis of this ruling, Asik's trial can resume only after his immunity is revoked or after the close of the Parliamentary session.
